1. Introduction
These Terms of Service ("Terms") govern access to and use of the KwariGo platform operated by AKM Innovations Ltd. (RC 8759581) ("KwariGo", "we", "us", or "our"), including our website at https://kwarigo.com, vendor applications, storefronts, marketplace, and related services (collectively, the "Platform").
KwariGo is an online multi-vendor fashion marketplace. We provide technology that allows independent vendors to list and sell fashion-related products to customers. KwariGo acts as a marketplace facilitator and is not the seller of record for vendor-listed products unless expressly stated otherwise.
By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old to create an account or sell on KwariGo.
Users under 18 may browse the Platform only with the consent and supervision of a parent or legal guardian. A parent or guardian is responsible for any activity conducted by a minor on the Platform.
You must have the legal capacity to enter a binding contract under Nigerian law and provide accurate registration information.
3. Accounts & security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must notify us promptly at hello@kwarigo.com if you suspect unauthorised access.
We may suspend or terminate accounts that violate these Terms, applicable law, or our policies, or that pose a fraud, security, or reputational risk.
4. Marketplace role
Vendors are independent sellers. Product descriptions, pricing, availability, fulfilment, and customer service for vendor products are primarily the vendor's responsibility unless KwariGo expressly undertakes otherwise for a specific order or service.
KwariGo may facilitate payments through approved payment partners, provide order management tools, and offer logistics support directly or through approved partners.
We do not guarantee that any product, vendor, or transaction will meet your expectations. Your contract for the purchase of a vendor product is with the vendor, subject to these Terms and applicable consumer protection law.
5. Allowed & prohibited products
Vendors may list approved fashion-related items, including:
- Fashion apparel and ready-to-wear clothing
- Abayas, jalabiyas, khimars, and related modest wear
- Fabrics, shoes, bags, jewelry, and accessories
- Beauty and skincare products
- Other fashion-related items approved by KwariGo
6. Prohibited products & conduct
The following are prohibited on the Platform:
- Illegal goods or goods whose sale is restricted under Nigerian law
- Counterfeit, stolen, or misrepresented products
- Weapons, drugs, tobacco, alcohol (where restricted), adult products, hazardous materials, live animals, and prescription medicines
- Any item or conduct that infringes intellectual property, privacy, or other third-party rights
- Fraudulent listings, price manipulation, or abusive behaviour toward users or staff
7. Orders, payments & pricing
Prices are displayed in Nigerian Naira unless stated otherwise. Applicable taxes, delivery fees, and charges will be shown at checkout where required.
Payments are processed through Paystack and other approved payment providers. By paying on the Platform, you also agree to applicable payment provider terms.
KwariGo may charge marketplace commissions, subscription fees, or other fees to vendors as disclosed in the vendor dashboard, pricing page, or separate Vendor Agreement. Displayed product prices are set by vendors unless KwariGo operates a promotional campaign.
8. Delivery & fulfilment
Orders may be fulfilled by KwariGo directly or through approved logistics partners, depending on the service available for the order and location.
Estimated delivery times are indicative and not guaranteed. Risk of loss for physical goods passes in accordance with applicable law and the fulfilment model shown at checkout.
You must provide accurate delivery and contact details. Failed delivery due to incorrect information may result in additional charges or order cancellation.
9. Refunds & cancellations
Refunds are available for eligible orders that meet KwariGo's Refund Policy, incorporated by reference into these Terms.
Approved refunds are processed to the original payment method where possible. Processing times may depend on your bank or payment provider.
KwariGo or the vendor may cancel orders for stock unavailability, verification failure, suspected fraud, or policy violations. If you paid and an order is cancelled, eligible amounts will be refunded according to the Refund Policy.
10. Intellectual property
KwariGo owns or licenses the Platform software, branding, design, and content we create. You may not copy, reverse engineer, or misuse our intellectual property without written consent.
Vendors retain ownership of their product content but grant KwariGo a non-exclusive, royalty-free licence to use, display, and promote that content on the Platform and in marketing related to the Platform.
If you believe content on the Platform infringes your rights, contact admin@akmgroupinc.com with sufficient detail for us to investigate.
11. Disclaimers
The Platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant uninterrupted, error-free, or secure operation.
KwariGo is not responsible for vendor product quality, safety, legality, or fitness for a particular purpose except where liability cannot be excluded under Nigerian law.
12. Limitation of liability
To the maximum extent permitted by law, KwariGo and its directors, employees, agents, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
Where liability cannot be excluded, our total aggregate liability arising from or relating to the Platform shall not exceed the greater of (a) the fees paid by you to KwariGo in the twelve (12) months before the claim, or (b) ten thousand Nigerian Naira (₦10,000), except where a higher minimum is required by law.
13. Indemnity
You agree to indemnify and hold harmless KwariGo from claims, losses, and expenses arising from your use of the Platform, your listings, your breach of these Terms, or your violation of law or third-party rights.
14. Changes to these Terms
We may update these Terms from time to time. We will post the revised version on https://kwarigo.com and update the effective date. Material changes may also be communicated by email or in-app notice where appropriate.
Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms, unless applicable law requires otherwise.
15. Governing law & disputes
These Terms are governed by the laws of the Federal Republic of Nigeria.
Subject to mandatory consumer protection rules, you agree to the exclusive jurisdiction of the courts of Kano State, Nigeria for disputes arising from these Terms or the Platform.
